P061a DTC code

I have went from a Smarty to a Black Maxx and the Electronic Throttle Control (ETC) warning light and Code P061a ETC Level 2 Torque Performance has visited me twice in four days. i can clear it with my BM but it looks like it is going to keep coming back. any ideas?
