Letter to EPA from ATS

Sometimes it better to not fight the quicksand, because its about neck deep right now. Way un-cool.

wow... i think its insane how much attention this thread / letter is receiving.

i wonder what ATS has truely found out by their investigations. possibly a disgruntled employee who got layed off? times are tight, grudges are deep.

Problem is Eric , the damage is done and no matter what type of explanation you give the NET there are people to punch holes in your statements.

All I can say is that the companies representation to the customer over the years has preceeded itself.
 
this isnt good. hope the letter isnt true but if it is then were all screwed. good thang i kept my stock exhaulst.
 
received this letter from a source I feel is very reliable. I didn't not receive this letter with the hopes I would post it, it was just an fyi. As such, can anyone discredit this letter?

I am not saying we should ban ATS, nor boycott them. This is just an FYI for us who are in the industry

Dear AXXX:

I would like to start by thanking you for speaking with Stewart Cables and myself at SEMA. You and your team did a very good job of preventing the meeting attendees from rioting!

As you may or may not be aware, ATS Diesel has been working on certain emission technologies to better our niche in the diesel community. Currently, we’re funding and developing a very expensive Diesel Particulate Filter (DPF) technology; this product will allow more efficient flow, resulting in better fuel mileage and lower emissions than today’s technology. ATS’ profits are funding the majority of this project’s development budget.

A serious concern that we have — and dramatically affects the development of our new high flow DPF -- is the presence of so-called “DPF Delete Kits” on the market. Right now consumers are looking for a solution to the problematic factory DPF exhaust systems, and a few companies out there are manufacturing and/or selling these DPF delete kits for a very low margin.

As you’re aware, the main problem with DPF delete kits is this: for every illegal kit sold, research money is not invested into a real “fix” for the consumer’s problem. EPA has made it clear to the diesel manufacturing industry, in no uncertain terms, that DPF removal is illegal. However, at this time, EPA has been unable to enforce its regulations to get these illegal DPF delete kits off the street. When we spoke a few weeks ago, you mentioned that the EPA can only enforce so many of its regulations right now, and it’s becoming increasingly difficult to track offenders (whether they be manufacturers, resellers, or end users).

ATS has prepared a list of the larger DPF Delete kit manufacturers and resellers, gleaned from our knowledge of the industry, for you. We’ve also included support documentation for your convenience. A few of these act as resellers (in place of manufacturers) in an attempt to hide behind a “shell corporation.” Performance Diesel, Inc. (“PDI”) in St. George, Utah is one of these companies. Jared Wittwer, the owner of PDI, is also the creator of H&S Performance, (www.hsperformance.net). All of these kits are assembled at PDI in Utah and sold through PDI as though H&S Performance manufactures them. Attached is a copy of one of the receipts PDI invoices on; the part number should easily be used to help track down additional units that PDI or H&S have sold over the last year. We have been told by PDI’s manager that they sell over 100 units per month.
ATS is relying on the EPA to enforce its rules on this matter so we can generate enough revenue to properly manufacture a “fix” to the DPF problem. The word in our industry is that 1) if you don’t manufacture, you are allowed to resell, install, and use, and 2) manufacturers or resellers can hide behind the “Race Only’ labeling that the products are sold under. The fact is, and as I’m sure you know, nearly all of these kits are being used for on road trucks. Thank you for taking the time to listen.

How can u explain this part of the letter, if the attorney typed it up without Clint knowing before hand and then sent it to him then how did he(attorney) know ATS prepared a list of "larger DPF Delete Kit manufacturers and resellers"? And how did he get his hands on the support documentation?
 
There's no point in argueing with these guys. If they go to the extent they have to knife companies in the back while sucking the EPA's a$$ you should know they will get on the forums and say they didn't do anything wrong and it's somebodys fault other than their own... The damage is done.
 
I love this. The DPF is an after treatment to the exhaust. Putting a higher flow trap doesn't fix the problem with the engine. It doesn't fix the problem that post combustion fueling being used to mask HC emmisions after the NOx issue is fixed in the cylinder. Keep thinking the DPF is the problem.

I would like to know how putting a DPF on a 12v with a mechanical pump is going to work. I keep hearing this. What computer are you going to put on and where are you going to mount the fuel injector to pump in the fuel for regeneration?

What's next? I can't wait to see which major diesel association are going to hop on the Urea band wagon. What will the slogan be. Come on people. Let's all piss in the tank and reduce our NOx emissions.

Here is the tech info on the BlueTec stuff mercedes is using. Ford had the option to do this. But they put DPFs instead.

This is par for the course. ATS has screwed everybody out there. They put it to Piers, Ind. Inj., Several turbo munfactuers, Custome Valve body manfs, the list is a mile long. Anybody who's been in the business for the last 12 years know all the stories. Clint thinks he's GOD with Long hair and he's gonna put it to anybody who stands in his way. Its just the way they work and do business. I'm glad to hear to it's finnally getting brought out where everybody can see. Gripe all you want, the way to put an end to this Purple BS is to BUY from somebody else. ATS does make some quality products, but its the BS like this that makes me shop elsewhere.
 
Letters like that do get circulated without any security measures. I work with a larger organization, and have our lawyers draft stuff up all the time. It will go through proofs and editting via email.

The final letter, however, is always signed, on letterhead, sent certified mail. A PDF copy is usually sent via email, and that is noted on the letter itself.

The letter, however, is a fake - the tense and verbage usuage does not agree, and leaves doubt as to who, what, and when.

Example:

As you’re (always spelled out, as YOU ARE. Additionally, the EPA (is always referred to as "THE AGENCY"...I mean, who the *he!!* is *you*?) aware, the main problem with DPF delete kits is this: for every illegal kit sold, research money is not invested into a real “fix” (what is a "FIX"? vague - never used in legal letter, nor would they use quotes) for the consumer’s problem. EPA has made it clear to the diesel manufacturing industry, in no uncertain terms, that DPF removal is illegal. However, at this time, EPA has been unable to enforce its regulations to get these (THESE?) illegal DPF delete kits off the street (off what *street*? too man slang terms used already in this letter). When we (who's WE?) spoke a few weeks ago, you (you who?) mentioned that the EPA can only enforce so many of its regulations right now, and it’s (no apostrophies) becoming increasingly difficult to track offenders (whether they be manufacturers, resellers, or end users).

And on top of that, this has NOTHING to do with the consent decree.

I personally think this is incredible information as to who actually wrote the letter. From the sounds of it, either the attorney really doesn't know how to draft a letter in the proper legal context. Or Clint was the person that wrote the letter and is putting the blame on the only person involved that could possibly take the blame and take the heat away from the company. That would also explain how the information got into the letter in regards to the company's providing DPF deletes and invoices. There is no way an Attorney would have that much information on the company's breaking the rules without having outside input.

I am with a lot of others on caling this BS untill I see otherswise, cause how does this "attorney" come up with this list on his own or what not. Just not making sense to me.

Clit Cannon has always been a p.o.s. and also turned in DDP in monroe, along with other washington and canadian based companys. Its been none for the last couple years the letters that he has been sending to the E.PA. about certain injection and turbo companys throughout the U.S.

We should never forget this and it is amazing that he is going this far to put alot of us out of buisness or worse yet infront of a judge.

Have you any evidence to back this up? Because it sounds like rumor mongering, and it certainly paints the picture that this is a recurring habit instead of a one-off incident. That's an even bigger accusation IMHO.

Just trying to keep things fair and balanced here.
